Porcelain Report is a platform that allows users to discover, rate, review, and share information about toilets and toilet facilities that are available to the public or provided as part of a commercial venue or service.

Porcelain Report is intended to help users share information about facilities such as public toilets, toilets in restaurants, cafés, pubs, shopping centres, transport facilities, attractions, hotels, cinemas, and other publicly accessible or commercial locations.

You must be legally able to enter into a binding agreement to use the Platform.

If you are under the age of 18, you may only use the Platform with the permission and supervision of a parent or legal guardian, where required by applicable law.

You are responsible for ensuring that your use of the Platform complies with all laws and regulations applicable to you.

You may submit reviews, ratings, photographs, comments, and other content ("User Content") relating to:

• Public toilets and public toilet facilities;
• Toilets located in commercial premises or venues;
• Toilets provided for customers, visitors, guests, or members of the public;
• Toilets in locations such as restaurants, cafés, pubs, shops, shopping centres, hotels, cinemas, attractions, transport hubs, service stations, and similar venues;
• Other toilet facilities that are reasonably available to the public or connected to a commercial service or venue.

Reviews should be based on your genuine experience or reasonable observations of the relevant facility.

Reviews must not be about workplaces or workplace toilet facilities.

You must not submit reviews, ratings, photographs, or other User Content concerning:

• Toilets located solely within an office, workplace, factory, warehouse, school, or other private working environment;
• Toilets intended primarily for employees, staff, contractors, or workers;
• Workplace facilities where the review could identify, target, or expose an employer, employee, colleague, or individual worker;
• Private staff toilets or facilities not intended for public or general commercial access.

This restriction applies even if you are, or were, an employee, contractor, or visitor at the workplace.

Porcelain Report may remove any content that it reasonably considers to relate to a workplace or private employee facility.

You may be required to create an account to access certain features of the Platform.

You agree to:

• Provide accurate information;
• Keep your login details secure;
• Not share your account with another person;
• Notify us promptly if you believe your account has been accessed without permission.

You are responsible for activity carried out through your account unless the activity occurred because of a failure by Porcelain Report to maintain appropriate security.

We reserve the right to suspend or terminate accounts that breach these Terms or are otherwise used improperly.

You retain ownership of User Content that you submit to the Platform.

However, by submitting User Content, you grant Porcelain Report a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, modify, adapt, publish, display, distribute, and otherwise use that User Content in connection with operating, improving, promoting, and providing the Platform.

This licence continues for as long as necessary for those purposes, subject to applicable law and our Privacy Policy.

You represent and warrant that:

• You have the right to submit the User Content;
• Your User Content is not knowingly false or misleading;
• Your User Content does not infringe another person's intellectual property, privacy, or other rights;
• You have not unlawfully obtained the User Content;
• Your User Content complies with these Terms and applicable law.

Reviews should reflect your genuine experience and should be expressed fairly and honestly.

You must not:

• Submit reviews that you know are false or misleading;
• Submit reviews about a facility you have not reasonably experienced or observed;
• Submit multiple reviews intended to manipulate ratings;
• Review your own business or a business in which you have a personal or financial interest without making that interest clear;
• Submit reviews in exchange for payment, gifts, discounts, or other benefits where this would make the review misleading;
• Coordinate fake or malicious reviews;
• Use reviews to threaten, harass, extort, or intimidate individuals or businesses.

We may remove or restrict reviews that we reasonably believe breach these requirements.

You must not use the Platform to:

• Harass, threaten, abuse, or intimidate any person;
• Publish personal information about individuals without a lawful basis or appropriate permission;
• Identify private individuals unnecessarily;
• Post content that is defamatory, hateful, discriminatory, obscene, or unlawfully abusive;
• Upload malware, viruses, or other harmful code;
• Attempt to gain unauthorised access to the Platform or another user's account;
• Interfere with the operation or security of the Platform;
• Use automated systems to scrape, copy, or collect Platform data without our permission;
• Impersonate another person or organisation;
• Use the Platform for unlawful purposes.

If you upload a photograph or image, you must ensure that you have the necessary rights or permissions to use it.

You should avoid photographing identifiable individuals without their permission.

You must not upload photographs that unnecessarily reveal:

• Private individuals;
• Personal information;
• Sensitive personal data;
• Private workplace areas;
• Any content that is unlawful or inappropriate.

We may remove images that breach these Terms or that we consider unsuitable for the Platform.

Information about businesses, venues, public facilities, and toilet locations may be submitted by users or obtained from third-party sources.

Porcelain Report does not guarantee that all information is accurate, complete, current, or available.

Opening hours, access arrangements, facilities, charges, accessibility, cleanliness, and other conditions may change without notice.

Users should verify important information independently where necessary.

We may, but are not generally obliged to, monitor, review, moderate, edit, restrict, or remove User Content.

We may remove or restrict content where we reasonably believe that it:

• Breaches these Terms;
• Is unlawful;
• Is misleading or fraudulent;
• Relates to a workplace or private workplace toilet;
• Infringes another person's rights;
• Creates a risk to users, businesses, individuals, or the Platform;
• Is otherwise unsuitable for Porcelain Report.

We may also suspend or terminate access to the Platform where appropriate.

If you believe that content on the Platform breaches these Terms, is unlawful, or infringes your rights, you may report it through the reporting features provided on the Platform or by contacting us.

Where appropriate, we may investigate reported content and take action.

The Platform, including its software, design, branding, logos, text, graphics, features, and other materials, is owned by or licensed to Porcelain Report and is protected by applicable intellectual property laws.

You may use the Platform for its intended personal and lawful purposes.

You must not copy, reproduce, modify, distribute, sell, licence, reverse engineer, or commercially exploit any part of the Platform unless permitted by law or with our written permission.

The Platform may contain links to third-party websites, services, venues, businesses, or applications.

We are not responsible for third-party services, their availability, content, security, or privacy practices.

Your use of third-party services may be subject to separate terms and conditions.

We do not guarantee that the Platform will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, withdraw, or discontinue any part of the Platform at any time.

We may carry out maintenance, updates, or changes that temporarily affect availability.

Porcelain Report provides a platform for users to share information and opinions.

Reviews and User Content represent the views of the users who submit them and do not necessarily represent the views of Porcelain Report.

To the maximum extent permitted by law, we do not guarantee the accuracy, reliability, completeness, or suitability of information provided through the Platform.

You should use your own judgement when relying on reviews or other information.

To the maximum extent permitted by applicable law, Porcelain Report will not be liable for any indirect, incidental, special, consequential, or economic loss arising from or connected with:

• Your use of, or inability to use, the Platform;
• Reliance on User Content or information available through the Platform;
• The actions or conduct of other users;
• The availability, condition, quality, safety, cleanliness, accessibility, or suitability of any toilet or venue reviewed on the Platform;
• Any third-party website, service, venue, or business.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by law, you agree to indemnify and hold harmless Porcelain Report and its owners, operators, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

• Your breach of these Terms;
• Your User Content;
• Your unlawful use of the Platform;
• Your infringement of another person's rights.

Our collection and use of personal information is explained in our Privacy Policy.

By using the Platform, you acknowledge that your personal information may be processed in accordance with that Privacy Policy.

We may update these Terms from time to time.

Updated Terms will be made available through the Platform. The "Last updated" date at the beginning of these Terms will indicate when the Terms were last changed.

Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of England and Wales, unless applicable law requires otherwise.

The courts of England and Wales will have jurisdiction over disputes arising in connection with these Terms, subject to any mandatory rights you may have under applicable law.
